The Copyright of all visual and audio material including project assets that have been created by Damon Ashworth is solely owned by Damon Ashworth and protected under UK Law. Damon Ashworth retains full and exclusive ownership of all original and additive work I create for a client until full payment is received. The right to use any media content Damon Ashworth has officially licensed from third parties will not be transferred to a client until full payment has been received. Damon Ashworth reserves the right to use any and all material created for self-promotional purposes unless specifically requested not to do so by the client. Items created within the confines of a Non-Disclosure Agreement will not be used for self-promotion without prior agreement from the client.
Copyright (material provided by client)
Any material provided by the client shall be considered as the clients proprietary property for which all useage rights are owned or have been obtained. It is the clients responsibility to transfer these useage rights to Damon Ashworth. I shall be entitled to use client provided material for the purpose of commissioned work, any issues of copyright infringement resulting from client provided material will be the responsibility of the client and the client will be responsible for the payment of any and all compensation to injured parties including any expenses Damon Ashworth incurs.
Payment terms
My payment terms are strictly 28 days from the date of the final invoice. This Term overrides any Terms and Conditions stated in a Purchase Order and in the event of an order being placed, the Client accepts this Term. As per UK government late payment rules ‘statutory interest’ will be applied to late payments this is 8% plus the Bank of England base rate. Due to erratic payment timescales from some customers and an increase in defaulters during the pandemic commercial clients must now pay a deposit before work commences on their first direct order with me. On completion of and full payment on the first project clients will not be required to leave a deposit for any further work commissioned but receipt of full payment will continue to be strictly 28 days from the invoice date. None commercial clients must pay a 50% deposit before work will commence and will be expected to pay their invoice in full before any media without a watermark is released to them. If the client cancels an order after work has proceeded they will be charged for any work undertaken and expenses incurred up to the cancellation date at a rate relative to the agreed cost, preparation hours and percentage of work completed. Damon Ashworth retains ownership of all original and additive work I create until full payment is received.
All Terms and Conditions stated within this document override any Terms and Conditions from the Client.
